    The terms for browsing, ordering, delivery, returns, and customer rights when buying from Talking Stone Gallery.

    General terms

    These terms apply when you browse this website, create an account, add items to your cart, or place an order with Talking Stone Gallery.

    By placing an order, you confirm that you have read these terms and that the information you provide is accurate, complete, and suitable for fulfilling the order.

    Customer accounts

    Customers are responsible for keeping account login details secure and for all orders placed through their account unless unauthorised use is reported promptly.

    We may suspend or restrict account access if we reasonably believe an account is being misused, used fraudulently, or used in a way that could harm other customers or the website.

    Products and availability

    Many Talking Stone Gallery pieces are unique artworks made from natural materials. Colour, texture, inclusions, surface character, and scale can vary between pieces and from screen images.

    Products are offered subject to availability. If a listed item is unavailable, sold, incorrectly listed, or cannot be supplied, we will contact the customer and arrange a refund, replacement, or suitable alternative where possible.

    We reserve the right to limit quantities, correct product information, update descriptions, or remove products from sale without prior notice.

    Pricing and charges

    Prices are shown in New Zealand dollars unless stated otherwise. Any delivery charges, discounts, or order totals shown at checkout form part of the order price.

    Delivery charges may vary based on destination, parcel size, parcel value, shipping method, and whether insurance or tracking is required.

    If an obvious technical, pricing, or listing error affects an order, we may correct the error and contact the customer before accepting or dispatching the order. If the corrected order is not accepted, a refund will be arranged for any payment already received.

    Payment

    Orders must be paid using the payment options available at checkout. Payment methods may change from time to time without prior notice.

    Payment card details are processed by secure payment providers and are not stored directly by Talking Stone Gallery on this website.

    An order is not confirmed for dispatch until payment has cleared and the order has been accepted for fulfilment.

    Order changes and cancellations

    Customers should contact us as soon as possible if they need to change or cancel an order. We will try to help where the order has not yet been packed or dispatched.

    Once an order has been dispatched, cancellation may no longer be possible. Any return or refund request after dispatch will be assessed under the returns and consumer rights sections below.

    Delivery

    We aim to pack orders carefully and deliver them using suitable tracked or insured services where available. Delivery timeframes are estimates only and are not guaranteed.

    Talking Stone Gallery is not responsible for delays caused by courier networks, customs processing, incorrect delivery information, weather events, public holidays, remote delivery areas, or other events outside our reasonable control.

    Customers should inspect parcels promptly after delivery. Any shortage, incorrect item, or transit damage should be reported as soon as possible with order details and clear photos so we can assess the issue.

    International orders

    International customers are responsible for ensuring the ordered item can be imported into the destination country and for paying any customs duties, import taxes, brokerage fees, or local charges applied on arrival.

    Customs charges and border delays are outside our control. If a parcel is refused, unclaimed, or returned because duties or import requirements are not met, any refund may exclude delivery costs, return costs, fees, and losses incurred by Talking Stone Gallery.

    Returns and refunds

    Customers must contact us before returning any item. Returned items should be unused, safely packaged, and accompanied by proof of purchase unless we agree otherwise.

    Change-of-mind return requests are assessed case by case, especially because many pieces are unique artworks, carved natural stone, or made in limited quantities. Original delivery charges and return shipping costs may not be refundable for change-of-mind returns.

    For hygiene and safety reasons, some wearable items may not be suitable for change-of-mind return once worn or handled beyond what is reasonably needed to inspect them.

    Damaged, faulty, or incorrect goods

    If an item arrives damaged, faulty, incorrect, or materially different from its description, contact us promptly with photos, packaging details, and the order number.

    Where a remedy is required under New Zealand consumer law, we will work with the customer to arrange an appropriate repair, replacement, refund, or other remedy.

    New Zealand consumer rights

    Nothing in these terms limits any rights customers may have under the Consumer Guarantees Act, Fair Trading Act, or other applicable New Zealand consumer laws.

    We aim to describe products accurately, honour valid consumer guarantees, and deal with customer concerns fairly and in good faith.

    Privacy and communications

    Customer information is handled in line with our Privacy Policy. Personal information may be used to process orders, provide support, maintain accounts, prevent misuse, and meet legal or accounting obligations.

    If customers choose to receive promotional messages, they may unsubscribe from marketing communications at any time. Transactional messages about orders, accounts, delivery, or support may still be sent where needed.

    Website use and intellectual property

    The images, product descriptions, written content, branding, layout, and other materials on this website belong to Talking Stone Gallery or its licensors unless stated otherwise.

    Customers may use the website for personal shopping and information purposes only. Content may not be copied, republished, scraped, or used commercially without written permission.

    Website availability and liability

    We aim to keep the website available and accurate, but we do not guarantee uninterrupted access, error-free operation, or that every display image will match a customer’s device colour settings.

    To the extent allowed by law, Talking Stone Gallery is not liable for indirect loss, loss of opportunity, or loss caused by events outside our reasonable control. Any liability that cannot be excluded will be limited as permitted by New Zealand law.

    We may update these terms from time to time. The version published on this page applies from the stated last updated date unless a specific order is governed by earlier terms agreed at the time of purchase.
